DMSH AS (“DMSH” or "we", "us", or "our"),”) is the holding company of a group made up of several entities operating internationally (“C-MAP entities”), including the C-MAP companies listed at paragraph 9.

DMSH, in accordance with its commitment to international compliance with data protection laws, is committed to protecting personal data collected through use of its websites and products, according to any national legislation in force on personal data protection.

DMSH is the data controller for all the organizations within the group. This means DMSH determines what data is collected by each organization, how this data is going to be used and how this data is protected.

In this document, we will explain how we collect, use and protect your personal data.This privacy policy applies to the C-MAP family of companies (C-MAP) with respect to compliance with applicable law and regulations regarding personal data.

Using your social media details to sign into your C-MAP Webstore account

When you sign in to our sites or apps using your Facebook login details, you give permission to Facebook to share with us your email address and certain aspects of your Facebook profile if you have made these public on your Facebook profile. This only includes your first and last name, age range, link to your Facebook profile and profile picture. We do not have access to updates on your Facebook profile.

We will then use this information to form a profile for your C-MAP Webstore account.

Social media in our products and services

Some of our products allow access to social media and allow you to share your data. How the information you share with social media is used is subject to the way each social media works and is governed by their privacy policies. DMSH has no influence over this.

When you use Genesis Maps

When you provide this personal data to us.

How we use your name, contact details (email address), unique user ID, password, product number

When you use Genesis Maps and upload your track data (or if you enable the automatic upload).

We will use this information to provide you the service.

When you upload your sonar log on Genesis Maps, this information is processed automatically in an aggregated and anonymous form to help improve“Social Maps” by updating depth contours, vegetation layers and bottom hardness data. Then making these changes available to the “Social Map”. With a paid account a trip can be marked as private and thus it is not shared in the “Social Map”.

Aggregated data used for this purpose is derived from your sonar log data (information uploaded on the server). The data aggregated and anonymized and no personal data will be published or disclosed and no person is identified or identifiable from such data. Data received from sonar logs may be redistributed for scientific research. This data would include but not limited to depth, vegetation and bottom hardness. Any data shared does not include personal information.

When you use BioBase software

When you provide this personal data to us.

How we use your name, contact details (email address), unique user ID, password, product number

We will use this information to analyze them and provide detailed charts and layered maps and other services as requested.

When you upload your sonar log to Biobase, this information is processed automatically in an aggregated and anonymous form.This data may be used for Genesis Maps “Social Maps” by updating depth contours, vegetation layers and bottom hardness data. Then making these changes available to the “Social Map”. Aggregated data used for this purpose is derived from your sonar log data (information uploaded on the server). The data aggregated and anonymized and no personal data will be published or disclosed, and no person is identified or identifiable from such data.


Data received from sonar logs and satellite images may be redistributed for scientific research. This data would include but not limited to depth contours, vegetation layers and bottom hardness. All data shared does not include personal information.


When you use other Commercial C-MAP products

Legitimate Interest

Broadly speaking legitimate interests means that we can process your personal data if:

We have a genuine and legitimate reason and we are not harming any of your rights and interests

So, what does this mean? When you provide your personal details to us we use your personal data for our legitimate business interests to send you information on our new services that might be useful for your business.

Before doing this, though, we will also carefully consider and balance any potential impact on you and your rights.

3. How we share your personal data

C-MAP companies and other subsidiaries

We share personal data with DMSH controlled affiliates and subsidiaries for business purposes, such as, internal administration, promoting DMSH products and providing customers with our DMSH products and services. It is our legitimate interest to process your personal data for these purposes.

Third parties to whom we transfer your data.

All the third parties to whom we transfer your personal data supply us with a specific service, as stated below.

We do not allow our suppliers to use your data for their own purposes, and we require that processing is in accordance with our instructions. We enter into written data processing agreements with suppliers that receive personal data from us.

Personal data which we collect are transferred to or accessed by third parties on our behalf, with your consent where necessary.

The types of third parties apart from the C-MAP companies already stated are:

  • Marketing and research companies who run and manage marketing and research campaigns
  • Event companies who run and manage sponsored events
  • IT providers who provide us systems, services and hosting
  • Card Payment Services providers who operate payment platforms
  • Logistics and courier companies who transport our products to you
  • Law firms who provide legal advice to us (e.g. where there is a customer dispute)
  • In individual cases we may also share personal data with professional advisers acting as processors or joint controllers including lawyers (e.g. where there is a customer dispute), bankers, auditors and insurers based in countries in which we operate. They will provide consultancy, banking, legal, insurance and accounting services;
  • Law enforcement agencies or regulators where we believe, in good faith, that it is necessary to comply with the law or regulatory obligation or to protect the safety of DMSH, our customers or their clients, or the public or to enforce or apply our terms of business or other contracts

This is only shared in a secure manner and we will take all reasonable steps to ensure that your data will be handled safely, securely, and in accordance with your rights, our obligations, and the obligations of the third party under the law.

4. International transfer

Transfer of Personal Data abroad. The personal data that we collect from you may be transferred to, stored at, or otherwise processed in a destination outside the European Union and/or the European Economic Area, including without limitation the United States. In the event where your Personal Data are transferred outside the European Economic Area and/or outside the European Union where the European Commission has decided that the third country does not ensure an adequate level of protection, we undertake to provide appropriate safeguards which may include, but are not limited to, adopting European Commission contractual safeguards, participating in the US-EU Privacy Shield, obtaining your consent to the data transfer, or other binding safeguards that may be authorized by the European Data Protection Board.

If DMSH is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our web sites of any change in ownership or uses of your personal data, as well as any choices you have regarding your personal data.

 
5. Your rights

This section explains your legal rights in relation to your personal data held by us, including your right to:

  • access your personal data
    (commonly known as a “data subject access request” or “DSAR”). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it. If you want to obtain a copy of the data we hold about you, you can always write us at legal@navico.com.
  • ask for correction of your personal data
    (This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us. If you have an account on one of our websites (C-MAP Webstore, GoFreeshop, Genesis Map, Biobase, etc) you can directly edit your personal data in your personal account area. You can also contact us at this email address legal@navico.com.and we will correct your personal data.
  • ask for erasure of your personal data
    This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your personal data unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request. Please request any erasure of personal data at legal@navico.com.
  • object to processing of your personal data
    This enables you to object to processing where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. If you want to object to processing, write us at legal@navico.com.
    In some cases, we may demonstrate that we have compelling legitimate grounds to process your personal data which override your rights and freedoms.
  • Request restriction of processing of your personal data
    This enables you to ask us to suspend the processing of your personal data in the following scenarios: (a) if you want us to establish the data’s accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.   • Request the transfer of your personal data to you or to a third party
    We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the personal data to perform a contract with you. Please request the transfer of your personal data at legal@navico.com.
  • Withdraw consent where consent is the legal basis of processing.
    You can withdraw consent at any time where we are relying on consent as the legal basis on which we process your personal data. You can easily withdraw from consent by sending us an email to legal@navico.com. However, this will not affect the lawfulness of any processing carried out before you withdrew your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.


We are committed to working with you to obtain a fair resolution of any complaint or concern you may have about our use of your personal data. If, however, you believe that we have not been able to assist with your complaint or concern, you have the right to file a complaint with the data protection authority in your country (if one exists in your country) authority.

6. How we keep your personal data safe

We use technical and organizational security measures including encryption and authentication tools to protect your personal data, against manipulation, loss, destruction, and access by third parties.

Although data transmission over the Internet or website cannot be guaranteed to be secure, we and our business partners work hard to maintain physical, electronic and procedural safeguards to protect your personal data in accordance with applicable data protection requirements. Our main security measures are:

  • Tightly restricted access to your data on a “need to know” basis and for the communicated purpose only
  • Transferred collected data in encrypted form when needed
  • Highly confidential data stored only in encrypted form
  • Firewalled IT systems to prohibit unauthorized access e.g. from hackers
  • Permanently monitored access to IT systems to detect and stop misuse of personal data.

  • If you have a personal password which enables you to access certain parts of our websites or any other portal, app or service we operate, do not forget your responsibility for keeping this password confidential. We ask you not to share your password with anyone.

7. Note regarding the use of the site by minors

Our websites are not directed at children. We do not knowingly collect Personal Data from children under the age of 16.
